Abstract

Transparency in the management of public resources constitutes a natural socio-political demand that has been present in the economy for a long period of time. However, the emphasis and importance attached to this issue evolves dynamically which is evidenced by the increasing legislative measures in this area (within both the national law and European Union law). One of such measures was the introduction of the Register of Public Sector Partners as a special mechanism for qualified identification of ultimate beneficial owners within the subjects which trade with public sector entities. The authors analyse the legal regulation in question, also from the viewpoint of public procurement candidates for whom this legal regulation has brought a number of related new obligations, as well as from the viewpoint of liability regime existing between the partner of the public sector and authorised person.
