The pre-trial phase of the procedure under Article 258 of the Treaty on the Functioning of the European Union and the limits of the European Commission’s discretion in its context

Abstract

The article focuses on the analysis of the pre-trial phase of the procedure under Article 258 of the Treaty on the Functioning of the European 68 Union, with particular attention to the specificities of the various stages, as well as the European Commission’s discretion in them. Attention is also paid to circumstances of limitation of European Commission’s discretionary power in the pre-trial phase of the proceedings.
