Abstract

In this paper, the author focuses on specific issues related to the application of the ne bis in idem principle in the substantive criminal law. In addition to the general introduction, the author pays particular attention to the opinion of the Criminal law College of the Supreme Court of the Slovak Republic no. R 44/2017, which in its essence deals with the relation of the statement of guilt of accused and generally mitigating circumstances, precisely with regard to the principle of
prohibition of double addition.
