Personal interview versus oral hearing in asylum proceedings

Abstract

The contribution analyzes the process institute of the personal interview in the asylum procedure. Because of the problematic interpretation of its implementation in practice, it compares it with the institute of the General Admininistrative Procedure – oral hearing. At the same time it deals with the analysis of the related procedural provisions of the Act on Asylum and Administrative Procedure Act. The contribution thus offers an insight into one of the most common problems of the administrative authorities, namely the supportive use of the lex generalis provisions in relation to the lex specialis.
