Autonomous vehicles: the question of liability

Abstract

The paper deals with the applicability and limits of the existing legislation, especially at the level of EU law, to the damage that will 137 occur during the operation of an autonomous vehicle. In the first place, it is a model combining the strict liability of the vehicle operator, the legal regulation of which is left to the Member States, with a system of mandatory insurance. The second model, the so-called product liability of the manufacturer for damage caused by a defective product. Deficiencies can be found in both of these models, for which they cannot be applied to the operation of autonomous vehicles. Finally, we
deal with other developments at the level of EU law.
