Abstract

The paper deals with the issue of decision-making of relevant authorities in hard cases while it points out on impact of legal principles, rules and morality on decision-making process in sense of selected case. This case is about whether the unauthorized and unwarranted construction, which serves as a dwelling, is appropriate to remove. The paper deals with associated issues on the philosophical level and in the field of administrative, civil and constitutional law.
