Abstract

The system of judicial protection in the EU is different from the system of national judicial protection. In general, it can be assessed, in relation to direct actions before the CJEU, that these are admissible under relatively strict conditions. These conditions have developed over time, and their development does not seem to be complete. This article deals with the recent judgment of the Court of Justice in Case C-575/18 P Czech Republic v Commission, facts of the case, the legal opinion provided by the judges of the Court of Justice, and the Opinion of Advocate General Sharpston. In addition to summarizing the judgment in question, the purpose of the article is to assess its impact on the system of direct actions before the CJEU.
