These conditions have developed over time, and their development does not seem to be complete. This article deals with the recent judgment of the Court of Justice in Case C-575/18 P Czech Republic v Commission, facts of the case, the legal opinion provided by the judges of the Court of Justice, and the Opinion of Advocate General Sharpston.
